What Is Ghairat?

GHAIRAT (shame, honour and modesty) is an attribute which Islam stresses much. Once in the court of Qaadhi Musa Bin Ishaaq, a lady covered with her burqah claimed that her husband was indebted to her for 500 gold coins which were for her mahr. The husband contested her claim. The Wakeel (lawyer/representative) of the lady produced two witnesses to testify as is required by the Shariah to prove a claim which is denied.

Before testifying the witness requested that the lady removes her niqaab because he could not testify without recognizing her. It is permissible according to the Shariah for women to reveal their faces in the presence of the Qaadhi who hears their cases.

When the lady stood up and was about to open her niqaab, the ghairat of her husband could not tolerate another man looking at his wife. He therefore said: “I testify that I do owe my wife the 500 Ashrafis (gold coins) she is claiming. My wife should never expose her face to a stranger.”

The impact of the husband’s honour constrained the wife to say: “I have waived the entire debt from my husband.” The Qaadhi ordered that this episode be recorded as a lesson for posterity.

Concern for Sustenance

Assalaamu ‘alaikum

Respected ‘Ulama

I would like to know what du‘aa one can recite for an increase in rizq. Insha-Allah I will be having a baby soon and I will need to leave work to take care of my child. I only work because I have to help my husband, as what he earns is not sufficient for us, even though we live a rather simple life and basically just meet our expenses every month.

I hope that Allah Ta‘ala will open some avenue for us so that I don’t have to work. It really stresses me out as I don’t know what we will do – especially since a baby is coming and we will have extra expenses.

I know that Allah Ta‘ala is the Provider and is taking care of us, but I do not want to be in a situation where I have to ask anyone for financial assistance. I daily read my Surah Waaqi‘ah. Is there anything else that I can read or do?

Is it permissible to
say the phrase "The flu is in the air"

Answer:

1. The phrase ‘flu in the air’ in the understanding of the common masses refers to many people having contracted the flu and that others (who haven’t yet contracted the flu) could possibly contract the flu (i.e. IF Allah Taáala so decrees). This phrase would then merely mean that there is a prevalence of flu amongst the people. However, one’s Aqeedah/belief must remain correct; the reality of which is that illness is from Allah alone; hence Allah Ta’aala has decreed for so many people to contract the flu at a given time. In short, as long as the latter meaning is taken and not that some other phenomena is directly responsible for the flu, it would be fine to use this expression and it will not affect one’s Aqeedah and tenets of faith.

2. There is also no harm in stating that the cold front is coming from Drakensberg, in the sense that Allah Ta’aala is sending the cold from that area. The actual Creator of cold is Allah alone but the snowfall on the Drankensberg mountains is the apparent sabab/means which Allah Taáala has put into place for cold spreading throughout various parts of the country.

In conclusion, both these statements are acceptable, as long as one takes it to mean what has been explained above.

SAME-SEX MARRIAGES

Q: Is it permissible in Islam for a girl to marry a girl or a boy to marry a boy? Will this type of nikaah take place?

A: This is haraam. This is a recipe for Allah Ta'ala's wrath and curse. The one who considers this to be permissible is not even a Muslim; he has departed from Islam.

ALCOHOL-BASED SANITIZERS

Question:

Is it permissible to use sanitizer in islam as it contains 70 to 90 percent alcohol?

Answer:

It is impermissible to use alcohol-based hand sanitizers. The Shari’ah only gives permission to use Haram ingredients for the treatment of sickness if there are no Halaal alternatives available. Alhamdulillah, there are alcohol-free sanitizers obtainable on the market as well as the option of homemade sanitizers. Moreover, a sanitizer is a mere preventative measure, not an antidote. As such, allowance will not be given to use a Haram constituent.

MAKING DUA FOR A DECEASED KAAFIR

Muhtaram brother,

We have received your query which pertains to making Dua for a deceased Kaafir.

Our response is as follows:

The 9th Surah of the Quraan Sharif is named Surah Baraa’at which commences in the 10th Juz of the Quraan Sharif and terminates in the 11th Juz of the Quraan Sharif. One of the reasons for the Surah being referred to as Surah Baraa’at is that there are many

laws recorded in this Surah pertaining to the Kuffar which clearly indicate that we Muslims should absolve and disassociate ourselves from them in worldly matters as well as matters of the hereafter.

Hence, we are prohibited from performing the Janaazah Salaah of the Kuffar and seeking forgiveness for them after their demise. Allah Ta’ala mentions,

وَرَسُولِهِ وَمَاتُواْ وَهُمْ فَاسِقُونَ 􀉍ِّ 􀊪 وَلاَ تُصَلِّ عَلَى أَحَدٍ مِّنْهُم مَّاتَ أَبَدًا وَلاَ تَقُمْ عَلَىَ قَبْرِهِ إِنَّهُمْ كَفَرُواْ ِ

(When Rasulullah Salallahu Alaihi Wasallam was about to perform the funeral prayer of the leader of the Munaafiqeen, Allah Ta’ala addressed him saying,) Do not ever perform (the funeral) Salaah for any of them who die and do not stand over their graves (to bury them or to visit their graves). Undoubtedly they disbelieved in Allah and His Rasool and died as disobedient people (as Kuffaar).

My question is: What is your opinion on the Salafi. When i asked a pious person from my town, he told me there is absolutely nothing wrong with the salafi and its totally sharia complient. When i asked my father he gave a totally opposite answer.
I wanted to see what you honorable Aalims have to say about this.

Answer:

Salafi'ism is a sect which had mushroomed about 250 years ago. The cornerstone of the Salafi movement is the rejection of following one of the Four Madhaahib (school of thought) of the Ahlus Sunnah Wal Jama'ah on the basis of their hollow slogan of following only the ‘Qur'aan and Sahih Ahadith'. They refute the authentic position of the Shariah which was transmitted down the centuries from the Salaf-e-Saaliheen (the Pious Predecessors). The Salafis vehemently and vociferously denounce and refute the Taqleed (following) of the Four Madh-habs (school of thought) of the Sunnah. Besides this, the Salafi also subscribe to certain Aqeedah (beliefs) that are foreign to the Ahlus Sunah Wal Jama’ah. Your respected father is on the right for his concerns regarding the Salafi.

Allah protect us All and keep us on the straight path.

Remember that our safety is in us following the footsteps of our pious predecessors.

RESPONSE TO A FATWA ON VACCINES-MUFTI SIRAJ DESAI SAHEB HAFIZAHULLAH

QUESTION

A fatwa has been issued by the United Arab Emirates Fatwa Council that allows Muslims to take the Pfizer vaccine even though it contains pork gelatine. This has been reported in our local newspapers. According to the newspaper report, the chairman of this Fatwa Council stated that this vaccine (which contains pork) would not be subject to Islam’s restriction on pork if there are no alternatives, because of “the higher need to protect the human body”. It further adds that in this case the pork is considered a “medicine’, not a food, and that “vaccines have proven to be effective against a highly contagious virus”. Please comment on this fatwa

ANSWER:

In the Name of Allah, with whom lies all Correctness and Truth

If the newspaper report has accurately conveyed the gist of the fatwa, then I can emphatically state that the UAE fatwa council has erred gravely in its ruling. The conclusion that they have arrived at is baatil (false) and contrary to the principles of Shariah. The very premises on which the fatwa council has based its ruling are flawed and erroneous, as I shall further explain.

The Holy Quran has allowed the consumption of pork under one special circumstance, and that is when the individual is dying of hunger and has no alternate food that can be consumed at that point in time. At the same time the Holy Quran declares the pig as najisul-‘ayn, meaning that every single part of it is haraam and impure, and this includes its skin, hair, bones, teeth, organs, hooves, horns, etc. It is for this reason that the Jurists of Islam have prohibited the use of all parts of the pig even for medicinal purposes. It is, therefore, unbecoming and unprofessional of supposedly learned men in Deen to make a difference between the use of pork as a food and as a medicine.

It is stated in the famous Hanafi Fatwa Anthology, Al-Fataawal-Hindiyya: “Imam Abu Hanifa (rahmatullahi alaih) said that no benefit shall be derived from the skin or other parts of the pig......”

In the days of the former Fuqaha (Muslim Jurists), shoemakers used pig-hair to manufacture shoe-straps. There was no alternate fabric available for this purpose in those times. However, Imam Abu Yusuf (rahmatullahi alaih), a renowned Hanafi Jurist and Chief Justice of his time prohibited the use of pig hair even for this purpose.

Fitra, Fidya and Kafaara

*Fitra or Zakaatul Fitr* is an obligatory charity that must be paid at the end of Ramadaan. It is obligatory for every Muslim male and female,young or old, to pay Zakaatul Fitr. The head of the house (The father) will pay the fitra on behalf of his dependents ( wife and children etc )

*Rasulullah (Salallah Alayhi was salam) said : Zakaatul Fitr is paid as a means of purification for the fasting person ( from any wrong actions or words that was done or uttered) and it is a means of feeding the poor*.

The amount of Fitra is one Sa'a ,that was the means of calculation in the time of Rasulullah (Salallah Alayhi was Salam) , which is equivalent to 2,73 kg of rice in today's times.

The Fitra becomes obligatory at setting of the sun on the last fasting day of Ramadaan ( The night when the moon is going to be sighted) until after the rising of sun on Eid day or before the Imaam gets on to the Mimbar to deliver the Eid Sermon ( khutba)

Sending Jumuah Mubarak messages

Question:

Is it permissible to send Jumu'ah Mubarak every Jumu'ah?

Answer:

The Fatwa Kitaabs state that if a person greets and congratulates others on the day of Eid by saying, May Allah Ta'aala accept your fast, Taraweeh and Qurbani then such a greeting encourages one to carry out acts of worship, and it is a Dua at the same time. This act is Mustahab and proven from authentic narrations. Therefore, there is no harm in it [Re:- Fataawa Ibaadur Rahman Pg. 214 Vol. 3].

However, greeting on the day of Jumuah with the words of ‘Jumuah Mubarak’ is not proven, hence we advise abstention; especially in this era when it has taken on the form of a custom and innovation.

DAR-UL-‘ULUM DEOBAND FATWA ON THE SHIA

Are Shias Kāfir or not?

What is the ruling, according to the ‘Ulama of Deoband regarding this matter: are the Shia Kāfir or not?

Fatwa : 151-148/B=03/1442

The beliefs found in the books of the Ithna Ashariyyah Shia, these beliefs are in conflict with the foundational (Islamic) beliefs and the clear definite text of the Qur’an. Therefore, majority of the scholars, including the ‘Ulama of Deoband classify them as Kāfir and Murtad.

For example,

(1) they believe in Tahrif-ul-Qur’an

(2) they believe ‘their’ twelve Imams to be infallible, they say that it is binding to believe in them and if someone does not believe in them, he or she will not be a Mu’min. The status given to the Imams is higher than that of the Ambiya’. They believe that the Imams have been given knowledge of everything in the past and of the future too.

(3) They deny

Using zakaat funds to purchase food hampers

Q: Is it permissible to use zakaat funds to purchase hampers and feed the poor? Similarly, is it permissible to provide iftaar for the poor in the month of Ramadhaan using zakaat funds?

A: It is permissible to use zakaat funds to feed the poor provided the requirement of tamleek is found. Tamleek means to transfer ownership of the wealth to a recipient of zakaat. Therefore, if the poor are given the zakaat hampers, the zakaat will be discharged. If the poor are not given the zakaat hampers but are merely invited for a meal and allowed to partake of it, then zakaat will not be discharged since the requirement of tamleek is not found. Similar is the case regarding the iftaar food during the month of Ramadhaan. If the poor are given the iftaar hampers, the zakaat will be discharged. If the poor are not given the iftaar hampers but are merely invited to partake of food provided, then the zakaat will not be discharged since the requirement of tamleek is not found.

Masks and the False Arguments

A response to people who use the classic fallacious argument, "Well, if masks don't work, then why do surgeons wear them?"

I'm a surgeon that has performed over 10,000 surgical procedures wearing a surgical mask. However, that fact alone doesn't really qualify me as an expert on the matter. More importantly, I am a former editor of a medical journal. I know how to read the medical literature, distinguish good science from bad, and fact from fiction. Believe me, the medical literature is filled with bad fiction masquerading as medical science. It is very easy to be deceived by bad science.

Since the beginning of the pandemic I've read hundreds of studies on the science of medical masks. Based on extensive review and analysis, there is no question in my mind that healthy people should not be wearing surgical or cloth masks. Nor should we be recommending universal masking of all members of the population. That recommendation is not supported by

INTERFAITH

Our creed has stemmed from Ebrahim Alaihi salaam who was completely clear when it came to his stance on beliefs which contradicted the one'ss of Allah

"Indeed there has been an excellent example for you in Ibrahim and those with him, when they said to their people: “Verily, we are free from you and whatever you worship besides God, we have rejected you, and there has started between us and you, hostility and hatred forever, until you believe in God Alone.” [60:4].

Despite this being his own nation and his family as well he had the outstanding quality of hatred only for the sake of Allah.

He didn't say that he should maybe accommodate these beliefs for his own "Maslihat" or to bring them with tact. He spoke out the truth clearly and Allah is commanding us to take cue from him.

However, the most dangerous and unfortunately the most effective is the silent battle that is waged on the hearts and minds of our innocent children. The battle is waged with smiling faces, alluring fashions, deceptive articles and even “exciting” toys which leave subtle messages in the hearts of children. Eventually, Muslim children with Muslim names but western hearts and minds grow up without any spirit of Islam in their lives. Apart from a few practices which they perform in a ritualistic manner, their lives centre on materialism and chasing “fun.” The true purpose of our existence in this earth is then completely lost. Thus it is imperative that we recognise the harm of this battle that is being waged on the hearts and minds of the Ummah. Having recognised it, steps must be taken to safeguard ourselves and our children from the onslaught.
